Welcome to Flagmancer. These Terms of Service ("Terms") govern your access to and use of the Flagmancer service, including our website, applications, and related services (collectively, the "Service").

The Service is operated by Lukas Van Den Bosch ("we", "us", "our"), located in Belgium.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Flagmancer is an autonomous AI-powered agent designed to assist with Capture The Flag (CTF) cybersecurity challenges and authorized penetration testing activities. The Service provides:

• Automated reconnaissance and vulnerability scanning
• AI-driven exploitation assistance
• Real-time session monitoring and logging
• Findings documentation and reporting

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

By creating an account, you represent and warrant that you meet all eligibility requirements.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

By using the Service to target any system, you represent and warrant that you have obtained proper authorization from the system owner. This includes:

• Written permission for penetration testing engagements
• Valid registration for CTF competitions
• Ownership or administrative rights over the target system
• Compliance with platform-specific terms (e.g., HackTheBox, TryHackMe)

We are not responsible for verifying your authorization. Any unauthorized use is solely your responsibility and may result in immediate account termination and legal consequences.

The Service, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the Service, including session configurations and notes. By using the Service, you grant us a limited license to process this data solely to provide the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• The Service will meet your specific requirements
• Any defects will be corrected

The Service is a tool to assist with authorized security testing. It does not guarantee successful exploitation or flag capture, and results may vary based on target configurations and other factors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages resulting from unauthorized access to your account
• Legal consequences of unauthorized testing activities

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Flagmancer and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any unauthorized testing activities conducted using the Service
• Any illegal activities conducted using the Service

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Suspected unauthorized or illegal activities
• Request by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

For users in the European Union, nothing in these Terms affects your statutory rights as a consumer under applicable EU law.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flagmancer regarding your use of the Service and supersede all prior agreements and understandings.
